In accordance with the provisions of Article 10 of Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (the “LSSI”), we inform you that the website http:/www.zadal.es/en (the “Website”) is operated by ZADAL ABOGADOS Y ASESORES TRIBUTARIOS, S.L.P (“ZADAL”), with NIF B87364956, registered in the Commercial Registry of Madrid.
This document contains the legal notice and terms of use of the Website (the “Legal Notice”) that ZADAL makes available to users.
Access to and use of the Website by the user (the “User”) implies full acceptance of and commitment to comply with the terms and conditions set forth in this Legal Notice. Therefore, the User must read this Legal Notice carefully each time they intend to use the Website, as it and its terms of use may be subject to change.
TERMS OF USE
The User agrees not to use the Website for fraudulent purposes, as well as not to engage in any conduct that could damage the image, interests, and rights of ZADAL or third parties. Likewise, the User agrees not to perform any act that could damage, disable, or overload the Website, or that could in any way impede its normal use and operation.
The User is informed that if they breach the contents of this Legal Notice, ZADAL reserves the right to limit, suspend, or terminate their access to the Website, taking any necessary technical measures to that end. Additionally, ZADAL reserves the right to take such measures if there is a reasonable suspicion that the User is violating any of the terms and conditions set forth in this Legal Notice.
Intellectual and Industrial Property
The intellectual and industrial property rights over the Website, including the arrangement of its contents, the sui generis right over the underlying databases, the graphic design and user interface of the Website (look & feel), the underlying computer programs (including source and object codes), as well as the various elements that make up the Website (texts, graphics, photographs, videos, sound recordings, etc.) (the “Content”), belong to ZADAL or its licensors. With respect to the distinctive signs included on the Website (trademarks and trade names), these are owned by ZADAL or its licensors.
The use of the Website by the User does not imply the transfer of any intellectual and/or industrial property rights over the Website, the Content, and/or the distinctive signs of ZADAL or third parties. To this end, through this Legal Notice, except in cases where it is legally permitted or prior authorization has been obtained from ZADAL, the reproduction, transformation, distribution, public communication, making available, extraction, and/or reuse of the Website, its Content, and/or the distinctive signs of ZADAL is expressly prohibited.
Linking Policy
Establishing Links to the Website:
Establishing links to the Website is prohibited unless previously authorized by ZADAL. In any case, once the link is authorized by ZADAL, it must be established under the following terms:
- The link shall only link to the homepage or main page of the Website.
- The link must not consist of frames that allow the Website to be viewed through different Internet addresses than those of the Website or that otherwise display the Website’s information together with that of other websites.
- No false, inaccurate, or incorrect statements about the Website and/or ZADAL may be made from the website that introduces the link (the “Linking Site”).
- In no case shall the authorization granted by ZADAL imply that: (i) it sponsors, collaborates with, verifies, or supervises the content and/or services provided through the Linking Site; or (ii) it is responsible for the content of the Linking Site.
- The Linking Site must fully comply with the law and must not host content, either its own or from third parties, that: (i) is unlawful, harmful, or contrary to morality and good customs (e.g., pornographic, violent, racist); (ii) may induce the User to mistakenly believe that ZADAL endorses, supports, or adheres to the ideas, statements, or expressions, lawful or unlawful, of the sender; or (iii) is inappropriate or irrelevant in relation to the activity of ZADAL.
In case of non-compliance with any of the aforementioned terms, ZADAL will proceed immediately and without prior notice to remove the link.
Linked Sites
To assist you in finding additional information, we may include various technical linking devices that allow the User to access other websites (the “Linked Sites”). In these cases, ZADAL acts as a provider of intermediary services as defined by Article 17 of the LSSI.
In no case does the existence of Linked Sites imply a recommendation, promotion, identification, or endorsement by ZADAL of the statements, content, or services provided through the Linked Sites. Consequently, ZADAL is not responsible for the content of the Linked Sites, nor for their terms of use and privacy policies, and it is the User’s sole responsibility to verify and accept them each time they access and use them.
If the User believes that any Linked Sites contain unlawful, harmful, defamatory, violent, or inappropriate content, they may inform ZADAL via the following email address: info@zadal.es. However, such communication will not in any case imply an obligation for ZADAL to remove the corresponding link and/or content.
Communication of Unlawful or Inappropriate Activities
In the event that the User or any other internet user becomes aware that any information or content on the Website or provided through it is unlawful, harmful to third-party rights, contrary to this Legal Notice, or in any way harmful or contrary to morality, customs, and decency, they may contact ZADAL indicating the following details:
- Personal data of the informant: name, address, phone number, and email address;
- Description of the facts revealing the unlawful or inappropriate nature of the content or information as well as the specific address where it is available;
- In the case of third-party rights violations, such as intellectual and industrial property, the data of the owner of the infringed right must be provided if it is a person other than the informant. The title that certifies the ownership of the infringed rights and, if applicable, the representation to act on behalf of the owner when it is a person other than the informant must also be provided.
In any case, ZADAL reserves the right to suspend or remove content that, although not unlawful, is contrary to the rules set out in this Legal Notice, weighing in each case the conflicting legal interests.
Responsibility of ZADAL
The User should be aware that communications over open networks are exposed to a variety of threats that make them insecure. It is the User’s responsibility to adopt all appropriate technical measures to reasonably control these threats, including having up-to-date systems for detecting malicious software such as viruses, trojans, etc., as well as keeping security patches for browsers up to date. For more information, the User can consult their Internet access service provider, who can provide appropriate solutions to their needs. To the maximum extent permitted by applicable law, ZADAL is not responsible for damages caused to the User as a result of risks inherent to the means employed or those caused by vulnerabilities in their systems and tools. ZADAL also does not guarantee the absolute security of its systems and, although it has implemented appropriate security measures, the existence of vulnerabilities cannot be completely ruled out, and therefore the User must be cautious when interacting with the Website. ZADAL will only be liable for damages caused by the use of the Website when such damages are directly caused by willful misconduct or gross negligence by ZADAL and provided there has been no negligence on the part of the User.
In particular, ZADAL will not be liable for:
- Damages of any kind caused to the User’s computer equipment by viruses, worms, trojans, or any other harmful elements.
- Damages of any kind caused to the User resulting from failures or disconnections in telecommunications networks that result in the suspension, cancellation, or interruption of the Website service during its provision. In this regard, the User acknowledges that access to the Website requires services provided by third parties outside the control of ZADAL (e.g., telecommunications network operators, access providers, etc.) whose reliability, quality, continuity, and operation are not the responsibility of ZADAL, nor is it part of its responsibility to guarantee the availability of the service.
- Information from third parties in cases where it acts as a provider of intermediary services as defined by the LSSI, except when there is actual knowledge and the corresponding information has not been removed.
Data Protection
Aspects related to the processing of Users’ personal data in connection with the use of the Website are governed by the Privacy Policy.
Miscellaneous
For the resolution of all disputes or issues related to this Website or the activities developed on it, Spanish law will be applicable, to which the parties expressly submit, with the Courts and Tribunals of the city of Madrid being competent for the resolution of all conflicts arising or related to its use, with the parties waiving any other general or special jurisdiction that may correspond to them. In the event that any of the provisions contained in this Legal Notice are declared null and void, they will be removed or replaced. In any case, such a declaration of nullity will not affect the validity of the remaining provisions contained in this Legal Notice.
